Regarding the above mentioned matter, we would like to advise you that the Trademark Law (Pyidaungsu Hluttaw Law No. 3, 2019) shall officially be taken into effect in Myanmar in January 2020. Accordingly, all trademarks that have been used or registered in the form of “Declaration of Ownership of Trademark” need to be re-filed at the Intellectual Property Department (IP Department) to maintain their effect.
The IP Department has set a time for the first six months of 2020 (referred to as the Soft opening period) to give priority to trademarks that have been registered or commercial used in Myanmar.
Re-filing can only be performed by online filing (e-filing) and must be through the Intellectual Property Representatives authorized and granted by the IP Department. Filing new trademark shall only be performed after the Soft opening period (referred to as the Grand opening period).
