Regulations on sanctioning administrative violations in the field of product and goods quality measurement standards (according to the Decree No. 80/2013/ND-CP dated July 19, 2013 of the Government)
Article 27.
1.Violating regulations on using barcodes
Fines of between 2,000,000 VND and 5,000,000 VND for:
a) Failing to notify in writing to Directorate for Standards, Metrology and Quality when changing the name, trading address or Barcode Certificate is lost or damaged;
b) Failing to produce a legal document proving the right to use the barcode when the competent authority requests
c) Not sending the GTIN, GLN lists to Directorate for Standards, Metrology and Quality;
d) Not notifying in writing attached documents proving the use of foreign codes with to Directorate for Standards, Metrology and Quality when using foreign codes for goods and product manufactured in Vietnam
2.Fines of between 6,000,000 VND and 10,000,000 VND for:
a) Using barcodes with the Vietnam country code (893) without having been granted Certificate of of the right to use the barcode by Directorate for Standards, Metrology and Quality.
b) Illegally using barcodes of other enterprises which have been granted Certificate by Directorate for Standards, Metrology and Quality;
c) Using signs causing confusion with barcodes;
d) Failing to pay annual maintenance fees for using barcodes.
3. Fines of between 10,000,000 VND and 20,000,000 VND for:
Acts of using foreign barcode to print on products or goods manufactured in Vietnam without written permission of foreign competent agency or the organization possessing such codes
Article 28. Violations of the use and grant of certificate of the right to use barcode
1. A fine of between 10,000,000 VND and 20,000,000 VND for:
a) Forging certificate of the right to use barcode;
b) Issuing certificate of the right to use barcode ultra vires.
2.Additional sanction:
Confiscation of fake certificate of the right to use barcode for violations specified at Point a, Clause 1 of this Article.
3. Remedies:
Forced revoke of certificate of the right to use barcode for violations specified at Point b, Clause 1 of this Article.
