On 31 October 2023, Myanmar enacted significant amendments to its Industrial Design Law (“IDL”). Effective from February 01, 2024, the Intellectual Property Department of Myanmar (IPD) commenced formal acceptance of industrial design applications in line with the updated legislation.

  1. Modernised Registration Rules: The Industrial Design Rules, announced on September 29, 2023, reflect Myanmar’s commitment to harmonising its practices with the Locarno Classification system and Paris Convention obligations.
  2. Structured Opposition Framework: Introduction of a 60-day opposition window post-publication enhances transparency and third‑party safeguarding.

Who Can Apply?

  • Domestic and International Applicants: Individuals and legal entities, foreign or local, may submit via a licensed local agent.
  • Paris Convention Priority: Claims must be filed within six months from the initial application filing date in any member state, supported by certified priority documentation.

Eligibility Criteria

Industrial designs must satisfy three core legal requirements:

Novelty Must be unpublished in Myanmar or abroad prior to filing or priority date. Designs registered only at the Deeds Office are excluded.

Inventive Character Should not be a mere combination of existing design features.

Public Policy Compliance Must not offend public order, morality, religious faith, or cultural values of Myanmar.

Application Essentials

  1. Locarno Classification: Classify design under the current 1968 agreement.
  2. Reproduction Requirements:
    • Drawings/photographs (B&W or colour), max 16×16 cm.
    • Minimum views: two for 2‑D, seven for 3‑D representations.
  3. Deferred Publication Option: Submit formal deferral requests if needed.
  4. Notarisation: Power of Attorney and other supporting documents must bear Notary Public certification.

Examination & Registration Timeline

  1. Formal Review: Verification of documents and formal compliance.
  2. Official Publication: If accepted, published in the gazette, opening a 60-day opposition period.
  3. Registration: In absence of oppositions, registration is granted.

Protection Term: 5 years from filing, renewable twice (5 years each), for a maximum of 15 years.
